Terms of Service

The agreement between you and TheyApply: what the market is, what each side owes the other, and the limits of what we promise.

Effective September 1, 2026

  1. 01Agreeing to these terms

These terms are the agreement between you and TheyApply for the use of theyapply.co. By entering the market, sending us a role, or otherwise using the service, you accept them. If you are agreeing on behalf of a company, you are confirming that you have the authority to bind it.

How we handle personal information is set out in our Privacy Policy, which forms part of this agreement.

  2. 02What TheyApply is

TheyApply is a talent market. Candidates enter once, describing their background and the terms they would move for, and stay on the market until they pause or leave. Employers do not search a database; they send a job description, and we return a ranked shortlist of candidates who meet the role's requirements.

We are not an employer, an employment agency acting for you, or a party to anything you go on to agree with a company you meet here. We introduce; you decide.

  3. 03Who may use it

You must be at least 16 and legally able to work in the places you tell us you want to work. One person, one profile: the market only works if each profile is a real individual, so profiles created on behalf of someone else, or in a name that is not yours, will be removed.

  4. 04What candidates agree to

    • Everything on your profile is true: your experience, your education, your authorization to work, and your résumé.
    • You will keep it current, and pause or withdraw when you are no longer looking, so that employers are not shown people who are not available.
    • You are responsible for the link to your dashboard. Anyone holding it can edit your profile.

You keep ownership of everything you upload. You give us permission to store it, to match it against roles, and to present the parts described in the Privacy Policy to employers considering you for a specific role. Nothing wider, and only while you are on the market.

  5. 05What employers agree to

    • You are hiring for a real, open role, and the description you send is that role.
    • You will use a shortlist only to evaluate those candidates for that role, and you will not copy it into a database, resell it, or reuse it for a different opening.
    • You will not attempt to identify or contact a candidate outside the process we provide.
    • You will comply with every law that applies to hiring, including equal-opportunity and anti-discrimination law, and you will not ask us to filter on any protected characteristic.

Fees, where they apply, are set out in the separate written agreement we sign with you. Nothing on the marketing pages of this site is by itself a binding quote.

  6. 06What nobody may do

    • Scrape, crawl, or otherwise extract data from the service by automated means.
    • Probe, overload, or interfere with the service or the infrastructure behind it.
    • Submit anything unlawful, misleading, or infringing, or upload files intended to cause harm.
    • Impersonate another person or company, or misrepresent your association with one.
  7. 07What we do not promise

We do not promise that you will be matched, shortlisted, interviewed, or hired, or that any role exists for your profile. We do not promise that any candidate we present will accept an offer, perform well, or be suitable, and the background information on a profile is what the candidate told us; verifying it is your job as an employer, not a service we provide.

The service is provided as is. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

  8. 08Limits on liability

To the fullest extent the law allows, TheyApply is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost opportunities, or lost data, arising out of your use of the service.

Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or one hundred US dollars. Some jurisdictions do not allow these limits, in which case they apply to you only as far as the law permits.

  9. 09Ending it

You may leave at any time: withdraw from your dashboard, or write to us and we will delete your profile outright.

We may suspend or remove an account that breaks these terms, misrepresents itself, or puts other people using the market at risk. Where it is reasonable to do so, we will tell you why.

  10. 10Changes to these terms

We may update these terms as the product changes. If a change materially affects your rights we will update the effective date above and give notice before it takes effect. Continuing to use the service after that means you accept the new version.

  11. 11Governing law

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules, and the state and federal courts located in New York County, New York have exclusive jurisdiction over any dispute.
